The earlier Poodle targeted SSLv3 which is obsolete while the newer Poodle vulnerability exploits TLS 1.2.
It wouldnt check the padding bytes but that wouldnt cause any problems in normal operation.
Thankfully, TLS 1.2 support is about to hit 50% at the time of writing.
